1.) THESE Antique & Collectable Investment (hereinafter referred to as ACI) Terms and Conditions of Business (hereinafter referred to as T&C) shall at all times be governed by and construed in accordance with the laws of England and Wales and shall be legally binding between us ACI 'The Seller' and you the 'Purchaser/Buyer.' In the event that any term or condition of these T&C is held to be invalid or uneforceable by judicial decree, the remainder of these T&C shall remain valid, binding and enforceable.
2.) WE advise that you fully read and 'download' these T&C as by using this website and purchasing items/goods from us you are herewith confirming that you have done so and that you acknowledge and agree to be legally bound by such.
3.) WE herewith reserve the right to alter or completely change these T&C at any time by posting such changes on-line to this website. We therefore kindly ask you to review on a regular basis these T&C to keep fully up to date. Any changes posted will take full and immediate effect but will not affect business previously conducted. Your continued use of this website confirms that you fully agree , comply with and have understood changes where made.
4.) THIS website may contain 'web-links' to other sites which are included and intended for 'information purposes' only. ACI cannot and will not under any circumstances whatsoever be liable for any content displayed, terms and conditions of business or use of these websites which you herewith acknowledge and agree are outside of our control.
5.) ACI herewith guarantee to all users of this website that any personal information submitted, passwors selected, account information or purchases made will be treated in the utmost strictest confidence. Information shall not at any time, in part or in whole, be passed to a third party without the express written permission and full consent and knowledge of the account holder.
6.) ALTHOUGH we endeavour to ensure complete accuracy of any and all information presented on this website, mistakes and errorrs can often occur. Where noticed or advised we do correct these as quickly as possible and kindly ask you to acknowledge this fact. It is your responsibilty to ensure accuracy by conducting your own research on an item, which we present for sale. We also kindly ask viewers of this website to notify us immediately where mistakes, ommissions, errors or inaccuracies have been noticed.
7.) ALL items/goods and services offered 'for sale' by ACI within our store or elsewhere on this website are so presented as'Invitations to Buy and Purchase' only and shall now under any cirmatances whatsoever constitute a legalling binding contract in law until the order process has been accurately and satisfactorily completed, your order has been satisfactorily received by ACI and your full and total payment has been acknowledged and received by ACI.
8.) IF you as the Purchaser/Buyer fail to comply with your obligations under these T&C in addition to all other rights and inclusions governed by English law granted to us the seller - ACI, we herewith reserve our full rights to proceed for full recovery of the full purchase price and other damages. We also reserve the right to cancel the transaction at any time and 're-sell' the item. Such other damages include, but are not limited to, the right to hold the purchaser/buyer liable to agreement of these T&C , pursue costs of collection, full costs of the item/goods purchased, handling fees, late payment fees and reasonable legal fees and costs incurred chasing you to comply with your obligations under these T&C.
9.) YOU herewith acknowledge and agree and abide at all times to comply with all applicable laws governing the use of this website, applicable 'Money Laundering' regulations and English law in general as applicable to conducting transactions and business with us. You are not at any time whatsoever permitted to register with us using 'false' details such as supply us with a false name or address, using another persons name or address or using a 'Password' other than originally allocated to you. In circumstances where we suspect this has occurred, we herewith reserve the right to report the matter to relevant authorities and the Police and to terminate your account with immediate effect.
10.) WE herewith reserve the right to assign this agreement and these T&C and to assign or sub-contract any or all of our rights and obligations herein. You may not without our express consent and written permission.
11.) IT is understood and agreed by all viewers/potential purchasers and purchasers to this website, items presented 'for sale' by ACI and presented within our store are of an 'Antique' and/or 'Collectable' nature within and regards to the general meaning and understanding of such terms (unless otherwise stated within the applicable product description). Thereby please understand, prior to purchasing, that (unless otherwise stated within the applicable product decriptione) all items/goods will be of a second-hand and/or pre-used condition, demonstrating and displaying signs of ware to external and internal packaging (if applicable) and on the item/goods themselves.
Such condition is regarded as completely usual and normal, both within the Antiques and Collectable industry and amongst the trade, dealers and regular collectors etc.
12.) WHILST every effort is made by ACI to accurately describe the condition of items/goods within the presentation of product descriptions on this website, it is understood and agreed by you the purchaser/buyer, prior to purchasing items/goods from us, that ACI has only a limited amount of space and time within each category for a description and we will only mention and disclose material facts likely (in ACI's opinion) to affect present and/or future values therefore it is further agreed and understood by you the purchaser that such decriptions made do not constitute a full, frank and detailed 'Condition Report' detailing every aspect of items/goods offered for sale. No responsibility or liability whatsoever in regards to issuing refunds of monies to any purchasers will be entered into with purchasers, where the excuse made by such purchaser is that of item/goods 'Condition' save where we have ommitted tot disclose a relevant, material and important fact (within the applicable product decription) which could be deemed and generally considered as most appropriate to do so in relation to the present/future value of such item/goods. ACI will guarantee to purchasers however, full and complete refund to purchasers will be issued in circumstances where fundamental omissions have occurred. (Please also refer to our 'Returns' page)
13.) ALL purchasers/buyers should satisfy themselves fully as part of their decision making process, whether the item/goods they intend to purchase from ACI are what they require as in line with industry practice, mistaken purchases, errors in purchasing etc will not generally be rectified by ACI once goods have been dispatched to a purchaser.
14.) YOU have the sole responsibility to notify us immediately if errors/mistakes have occurred in your purchasing, prior to our dispatch of items/goods. You should do this by immediate notification to us either by telephone or email immediately following the confirmation of your order to us when using our store 'checkout' facility. Upon satisfactory notification from you, we undertake to immediately cancel your order and make such refunds as applicable. We shall also confirm such actions to you in writing, usually by confirmation email.
15.) EVERY effort is continually made by us to appropriately pack purchased items/goods for transit to customers, it is understood and agreed by you that ACI cannot and will not under any circumstances whatsoever accept responsibility or liability for items/goods that arrive to purchasers in a damaged condition due to transit. It is therefore recommended by ACI, all purchasers should fully and appropriately 'insure' their purchases to cover this eventuality.
